Patent Office Grants D2L Reexam Request

The United States Patent and Trademark Office (USPTO) this weekend granted Desire2Learn its request for a reexamination of Blackboard Inc.'s e-learning patent. Desire2Learn is, at present, the defendant in a patent-infringement lawsuit filed by Blackboard in July 2006.

Canadian District To Expand Fast ForWord Implementation

School District 16 in New Brunswick, Canada has adopted Fast ForWord from Scientific Learning Corp. (SLC). Fast Forward is a family of digital learning tools designed to develop "the neurocognitive skills required to read and learn effectively." The district said the program boosted early reading skills dramatically and that it will use Fast ForWord with more students in the future.

Blackboard Connects Faculty and Students with Scholar

Blackboard has launched a new, free service for users of its CMS technologies: Scholar, a "social bookmarking" service designed to connect faculty and students across institutions. Scholar is the first product released from the Blackboard Beyond Initiative, which focuses on centrally hosted Web services.

Texas SBE Adds Saxon Math to Adoption List

According to Harcourt Achieve imprint Saxon Publishers, the Texas State Board of Education has approved Saxon Math Courses 1, 2 and 3 for its instructional materials adoption list for middle school students. The company said yesterday that the curriculum "is 100 percent conforming and covers each required element of essential knowledge and skills."

Corel Launches Painter X Curriculum

Corel Tuesday launched a new version of its painting an illustration suite, Painter X. Following that release, the company also announced a new visual arts curriculum at the annual convention of the Texas Computer Education Association (TCEA). The first part of the curriculum, called "Digital Painting and Sketching Using Corel Painter X," is now available free of charge.

Cherokee County Uses ViewCast for Distance Learning

Cherokee County School District in South Carolina has implemented new technologies in two of its high schools to support its distance learning courses. The district has adopted ViewCast's Niagara GoStream portable streaming media encoder to capture and encode classes, which are then broadcast to students unable to attend in person.

Update: Sakai, Blackboard Comment on Patent Pledge

Yesterday, we reported that Blackboard had released a legally binding pledge stating that the company would not assert its patent rights against open-source developers in the CMS space or against developers of "home-grown" systems. The non-assertion pledge also covers those who service such systems, including hosting, maintenance, support and customization. And it includes the current patent, as well as patents pending. We spoke with Blackboard representative Matthew Small, who provided some insight and clarification on the pledge. Since then, we've also had a chance to speak with Chuck Severence, executive director of the Sakai Foundation--a central player in the patent discussion--for additional comments.

In a surprise twist on the ongoing controversy over Blackboard Inc.'s e-learning software patent, the company today announced that it will not assert its patent rights against open-source developers. Blackboard had maintained previously that it was supportive of the pen-source community and that it would not be looking at those developers as targets for patent litigation, but it had stopped short of making a formal pledge until today.

Concurrently, critics of Blackboard's patent--in particular trade group EDUCAUSE and open-source developer Sakai--released a joint statement on the Blackboard patent pledge, supporting it but with some caveats. We had a chance to speak to Blackboard representative Matthew Small today to get some clarifications on the pledge.
